We are coming upon the fourth anniversary of the enactment of BAPCPA, the Bankruptcy Abuse Prevention and Consumer Protection Act that was designed to put more money into creditors' pockets and make life much much more difficult for debtors and their attorneys. It seemed that after the October 2005 enactment BAPCPA was widely reviled, feared and loathed. The week before its enactment bankruptcy filings spiked like never before or since, then nobody, really, NOBODY, filed for months.
After its enactment, when debtors finally HAD to file, it seemed as if courts were doing all they could to soften the hard edges of BAPCPA and restore life to a kinder, gentler way of bankruptcy practice. Over time, however, it appears that more courts than not are interpreting BAPCPA according to its terms, and things have certainly gotten tougher for debtors, as was undoubtedly the intent in its passage.
